Violations

Dependent upon the nature of a code violation, the Code Enforcement Officers use one or more of several enforcement avenues to enable them to bring violations into compliance with County regulations.

Avenues of Violation Correction
The Code Enforcement Board (CEB) is a quasi-judicial body (7 members), whose responsibilities are to receive and evaluate evidence and testimony regarding alleged violations of Orange County codes and regulations. The members of the CEB are appointed by the Board of County Commissioners (BCC). The CEB members represent varied community interests and possess diverse professional and civic backgrounds.

Examples of typical cases heard by the CEB include, but are not limited to: violations of regulations regarding land development, building standards, minimum housing standards, fire safety, etc.

Public hearings are held in the Commission Chambers on the ground floor of the Orange County Administration Center, 201 South Rosalind Avenue, Orlando, Florida 32802.

Public hearings are scheduled for specific dates and times. Typically, CEB hearings are held on the third (3rd) Wednesday of each month, beginning at 9:00 a.m. Notification is given as required by law.
Non-Criminal Citations

Non-Criminal Citations

In addition to use of the Code Enforcement Board process, Officers are empowered by State Statute and County Code to issue non-criminal citations. These citations, while requiring the defendant to appear in County Court, are classified as civil infractions. A person receiving a citation may choose to pay a reduced civil penalty and avoid a court hearing, or a hearing may be requested. However, if found guilty at a hearing, the responsible person may be ordered to pay the full penalty amount, without reduction.

Typically, citations are used as a last resort to correct violations which are on public property, such as illegal vendors or signage placed upon rights-of-way, but may be used for other code infractions on private property. Additionally, citations may be used for violations which are repeatedly created and corrected immediately prior to Code Enforcement Board hearings or where use of the Code Enforcement Board has not deterred the respondent from continuing the violation.

Injunctive relief is the process whereby legal action is taken through the court system to prevent the continuation of a nuisance violation.

Settlement Agreements may be reached between the respondent and County and authorized by the court system. Such agreements:

  • Establish the amount of money to be paid;
  • Set parameters on the operation; and
  • Establish a specific time frame to cure the violation.
