Violations include accumulations of junk and debris of any kind on residential or commercial property, excessive growth of grass and weeds (18" or higher).

If property owners do not comply with the code violation notices within 15 days, Orange County directs a contractor to clean the lot and passes the bill on to the owner. Failure to pay the bill results in a lien against the property, and enforced collection.

Natural state properties, i.e., unimproved tracts of land, are not covered by the ordinance.

A repeat lot cleaning penalty can be assessed if the county cleans a property more than once within a 12-month period. The penalty can be as much as $200 per violation.

ORANGE COUNTY CODE SECTION 28-33

Accumulations of trash, junk, debris and nonliving plant material on property utilized for residential, professional office, commercial, and industrial use.

No owner, agent, custodian, lessee or occupant of property utilized or zoned for residential, commercial, professional office or industrial use shall permit the accumulation of trash, junk, debris, or nonliving plant material on any exterior portion of the property, including the exterior portion of any building located thereon. Such property shall be maintained free of accumulations of trash, junk, debris, and nonliving plant material; provided, however, that this section shall not be construed to prohibit:

(i) the storage of trash, junk, debris and nonliving plant material in garbage containers or mechanical garbage containers which comply with all applicable ordinances;

(ii) the storage of nonliving plant material in compost bins in accordance with section 28-35; or

(iii) trash, junk, debris and nonliving plant material placed on property at a properly permitted and licensed junkyard, landfill or recycling operation operating in compliance with all applicable local, state and federal regulations.

High Grass & Weeds

ORANGE COUNTY CODE SECTION 28-34

Excessive growth of grass and weeds.

Excessive growth shall mean, for purposes of this article, living grass or weeds deemed to be in a state of excessive growth when such grass or weeds have reached a height of eighteen (18) inches.

(a)     No owner, agent, custodian, lessee or occupant of property utilized or zoned for residential, professional office, commercial, or industrial property shall permit the excessive growth of grass or weeds on any exterior portion of the property.

(b)     Except in those cases of health or safety concerns as determined by the Code Enforcement Manager, property utilized or zoned for residential, professional office, commercial, or industrial use within the county where the natural vegetative growth is a mature Florida ecological community, as defined by the Soils Conservation Service in their publication entitled, "26 Ecological Communities in Florida" (such publication is on file with the zoning director), is exempt from the provisions of subsection (a) which requires the cutting or removal of vegetation.
